It includes legal rights, fixed purchase costs and clear obligations that every buyer in Gurugram should understand before booking. Knowing these essentials helps you evaluate a project based on what the law guarantees, not just what the brochure promises.

This guide explains those rights under the Real Estate (Regulation and Development) Act, 2016 and the Haryana Apartment Ownership Act, 1983, sets out the GST, stamp duty and registration costs in Gurugram, lists the restrictions owners accept and ends with a pre-booking checklist and a new apartment launch in Gurugram.

Apartment Meaning Under Indian Law

An apartment is a residential unit in a building where you own the unit along with an undivided interest in the land and common areas. Under Section 4 of the Haryana Apartment Ownership Act, 1983, each apartment, together with its undivided interest in the common areas, is heritable and transferable property. This legal framework supports Apartment Living in India, allowing owners to sell, gift or inherit their apartments subject to applicable laws.

Under Section 2(k) of the RERA Act, carpet area is the net usable floor area of an apartment, excluding external walls, service shafts, exclusive balconies or verandahs and exclusive open terraces, but including internal partition walls.

Advantages of Living in an Apartment

Buyer Payments Held in a Separate Account

Under Section 4(2)(l)(D) of the RERA Act, the developer must deposit 70% of the amounts collected from buyers into a separate bank account, to be used only for the land and construction cost of that project. Withdrawals must be in proportion to construction progress and certified by an engineer, an architect and a chartered accountant. This applies to every project that must register, which under Section 3 covers any project on land above 500 sq m or with more than 8 apartments.

Booking Amount Capped Before the Agreement

Section 13(1) bars a developer from taking more than 10% of the apartment cost as an advance or application fee before signing a written agreement for sale and registering it. On a ₹2 Cr apartment, that limits your payment to ₹20 lakh until the agreement is registered.

Carpet Area Declared Before Sale

When a project registers, Section 4(2)(h) requires the developer to declare the number, type and carpet area of the apartments for sale, along with exclusive balcony and terrace areas. Because these details go on the RERA portal, you can match the carpet area in your agreement with the registered figure.

Structural Defect Cover After Possession

Section 14(3) makes the developer liable for any structural defect, poor workmanship or quality issue reported within 5 years of handing over possession. The developer must fix it within 30 days at no extra charge, and if it does not, the buyer is entitled to compensation.

Compensation When Possession Is Late

If possession is not given as per the agreement, Section 18(1) lets the buyer withdraw and get back the amount paid with interest, or stay in the project and receive interest for every month of delay until possession is handed over.

A Permanent Share of Land and Common Areas

Section 6 of the Haryana Apartment Ownership Act fixes each owner’s percentage of undivided interest in the common areas through the declaration. That percentage is permanent, cannot be changed without the consent of all apartment owners, and the common areas cannot be partitioned.

Residents Take Control of the Project

Section 11(4)(e) of the RERA Act requires the developer to enable an association of buyers within 3 months of a majority of units being booked. Under Section 17, the developer must hand over the common areas and project documents to the association within 30 days of obtaining the occupancy certificate, and execute the conveyance deed in the buyer’s favour within 3 months of it, where no local law sets another period.

No GST on a Ready Apartment

A ready apartment with an occupancy certificate attracts no GST, while an under construction apartment attracts 5% without input tax credit. On a ₹1.5 Cr purchase, that difference is ₹7.5 lakh.

Cost of Buying an Apartment in Gurugram

Cost

Rate

Applies to

GST, under construction

5%

Without input tax credit. The project is planned on about 20 acres with 7 towers of G+37 floors and around 900 homes, offering 3, 4 and 5 BHK apartments. Each core serves only 4 apartments, more than 80% of the land is planned as open space, and the project includes about 1.25 lakh sq ft of club and amenity space with parking across 3 basement levels.

Unit type

Size

Indicative price

3 BHK

2,500 sq ft

₹4.99 Cr

3 BHK

2,730 sq ft

₹5.46 Cr

4 BHK

3,490 sq ft

₹6.98 Cr

4 BHK

4,045 sq ft

₹8.09 Cr

5 BHK

About 5,000 sq ft

On request

Prices are indicative, work out to about ₹20,000 per sq ft and exclude taxes and statutory charges.
